4. Terms of Service

These Terms of Service ("Terms") govern your use of **staysharpsports.com** and purchases or services provided by Stay Sharp Sports (collectively, the "Services"). By accessing the Services, placing an order, or requesting work, you agree to these Terms and the policies incorporated into them, including our Return and Refund Policy, Shipping Policy, and Privacy Policy.
## 1. Eligibility and account responsibility
You must be legally capable of entering a binding agreement in your jurisdiction to make a purchase. A parent or legal guardian should place orders for a minor. You are responsible for information submitted through your account and for maintaining the confidentiality of account credentials.
## 2. Product and service information
We make reasonable efforts to describe products, colors, specifications, compatibility, inventory, pricing, and services accurately. Screen settings, manufacturer revisions, natural material variations, photography, and production changes may cause reasonable differences. Manufacturers may change nonessential specifications or packaging without notice.
Figure-skating equipment is specialized. Product descriptions and recommendations are general information, not guarantees that a particular boot, blade, size, stiffness, profile, or accessory is appropriate for every skater. Proper selection can depend on foot shape, skating level, technique, growth, training volume, coach guidance, fit preferences, and other individual factors.
## 3. Orders and acceptance
An order confirmation acknowledges receipt of your order but does not necessarily constitute acceptance. We may verify payment, inventory, pricing, shipping eligibility, fraud risk, or other order details before accepting and fulfilling an order.
We may refuse or cancel an order for legitimate reasons, including suspected fraud, payment failure, material pricing or listing errors, unavailable merchandise, shipping restrictions, or misuse of the Services. If we cancel a paid order, we will refund the canceled amount to the original payment method.
We may limit quantities sold to a person, household, account, geographic region, reseller, or order when reasonably necessary to protect inventory, customers, or the business.
## 4. Prices, payments, and taxes
Prices are shown in the currency indicated by the store and may change without notice. The price applicable to an accepted order is the price shown at checkout, except in the case of an obvious material error. Applicable shipping charges and taxes are calculated or displayed at checkout when available.
You represent that payment and billing information you provide is accurate and that you are authorized to use the selected payment method. Payment services are provided by Shopify and authorized payment processors and may be subject to additional terms.
## 5. Inventory and special sourcing
Specialist figure-skating products may be held by Stay Sharp Sports, allocated across selling locations, available from a supplier, or specially sourced. Displayed availability can change before an order is accepted and allocated. If an item becomes unavailable or materially delayed, we will contact you with available options consistent with our Shipping Policy.
Products sourced specifically for an individual customer may become final sale when the supplier order is placed, as described in our Return and Refund Policy.
## 6. Fitting, recommendations, and customer information
Customers are responsible for providing accurate sizing, skating, fit, and service information. Tell us about material fit concerns before authorizing modifications or skating in the equipment. Unless Stay Sharp Sports expressly agrees otherwise in writing, remote recommendations and purchases made without an in-person fitting cannot guarantee individual fit.
Heat shaping, punching, stretching, molding, sharpening, profiling, mounting, engraving, and other individualized work permanently affect merchandise and generally make it final sale. Completed labor is nonrefundable except when required by law or when Stay Sharp Sports confirms defective workmanship.
## 7. Blade mounting, sharpening, and equipment service
Customers requesting mounting or service represent that they are authorized to have the equipment altered. Used equipment and equipment supplied by the customer may contain wear, corrosion, hidden damage, prior holes, manufacturing variation, or structural weakness that is not visible before work begins.
We will exercise reasonable care, but we are not responsible for pre-existing damage, ordinary wear, manufacturer defects, inaccurate information supplied by the customer, or failure caused by equipment that was already compromised. If we discover a condition that materially affects safe or appropriate completion of requested work, we may pause the service and contact you.
Blade alignment, sharpening feel, rocker/profile selection, and mounting preference can involve skater feedback and reasonable professional judgment. Customers should inspect serviced equipment and communicate concerns promptly before extensive use.
## 8. Product use and safety
Use products only for their intended purpose and follow manufacturer instructions, warnings, maintenance guidance, and sizing requirements. Figure skating and athletic activity involve inherent risks. Inspect boots, blades, guards, fasteners, apparel, training devices, and accessories regularly and discontinue use if an item appears damaged, loose, excessively worn, or unsafe.
Protective guards, soakers, training products, heated apparel, batteries, and other accessories must be used and maintained as directed. Adult supervision is required when appropriate. Stay Sharp Sports does not replace the judgment of a qualified coach, technician, medical professional, or product manufacturer.
## 9. Shipping, returns, and refunds
Shipping, delivery, cancellations, returns, exchanges, and refunds are governed by our Shipping Policy and Return and Refund Policy. Those policies form part of these Terms. Nothing in these Terms waives rights that cannot lawfully be waived.
## 10. Promotions and gift cards
Promotions, discounts, giveaways, loyalty offers, and gift cards may be subject to separate stated conditions. Unless expressly permitted, promotions cannot be combined, applied retroactively, redeemed for cash, or transferred. We may correct or cancel a promotion affected by fraud, technical error, or misuse, subject to applicable law.
## 11. Reviews, submissions, and feedback
If you submit a review, photograph, comment, suggestion, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and does not infringe another person's rights. You grant Stay Sharp Sports a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display that content for operating, improving, and promoting the business, subject to applicable privacy law and any separate agreement.
We may moderate or remove unlawful, abusive, fraudulent, misleading, infringing, or irrelevant submissions. We are not obligated to publish every submission.
## 12. Intellectual property
The Services and their original text, graphics, branding, product presentation, videos, photographs, logos, software, and other content are owned by Stay Sharp Sports or used with permission and are protected by applicable intellectual-property laws. You may use the Services for personal, noncommercial shopping purposes. You may not copy, scrape, reproduce, republish, sell, or exploit protected content without authorization, except as allowed by law.
Manufacturer names, product names, and trademarks belong to their respective owners.
## 13. Prohibited conduct
You may not use the Services to violate law or another person's rights; submit false, malicious, or fraudulent information; interfere with store security or operation; distribute malware; attempt unauthorized access; scrape or harvest information in violation of law or our rights; place orders for unlawful resale or export; or abuse promotions, returns, reviews, chargebacks, or customer-service processes.
## 14. Third-party services
Our store may use or link to Shopify, Shop, payment providers, shipping carriers, video platforms, social networks, and other third-party services. Third-party services are governed by their own terms and policies. Stay Sharp Sports is not responsible for a third party's independent service, content, availability, or conduct, except to the extent required by law.
## 15. Disclaimer of warranties
To the fullest extent permitted by law, the Services and products are provided on an "as available" basis, subject to any express manufacturer warranty and non-waivable legal rights. We do not promise that the website will always be uninterrupted or error-free, or that a product will produce a particular skating, competitive, comfort, or performance result.
Nothing in these Terms excludes an express written promise made by Stay Sharp Sports, an applicable manufacturer warranty, or a consumer right that cannot legally be excluded.
## 16. Limitation of liability
To the fullest extent permitted by law, Stay Sharp Sports will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Services or products. To the fullest extent permitted by law, our aggregate liability relating to a product, order, or service will not exceed the amount paid to Stay Sharp Sports for the product, order, or service giving rise to the claim.
These limitations do not apply where prohibited by law and do not limit liability that cannot legally be limited.
## 17. Indemnification
To the extent permitted by law, you agree to indemnify and hold Stay Sharp Sports harmless from third-party claims, damages, and reasonable costs arising from your unlawful misuse of the Services, violation of these Terms, or infringement of another person's rights. This section does not require indemnification for Stay Sharp Sports' own unlawful conduct.
## 18. Governing law
These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict-of-law principles. Any dispute will be handled in a court with lawful jurisdiction, subject to any consumer rights that require a different venue or governing law.
## 19. Severability and waiver
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
## 20. Changes to these Terms
We may update these Terms to reflect changes in law, technology, products, services, or business practices. The updated Terms will be posted with a revised date. Changes apply prospectively unless applicable law permits or requires otherwise.
